Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records on the file of the second respondent in his proceedings Na.Ka.No.17396/L3/2010 dated 26.12.2012; the entire records related in G.O.(2D) No.8, Animal Husbandry, Dairying and Fisheries (FS2) Department dated 04.02.2013 issued by the first respondent insofar as the deferment of the petitioner for empanelment and promotion as Assistant Director of Fisheries and to quash the same and consequently, direct the respondents herein to include the name of the petitioner in the appropriate place in the panel for promotion to the post of Assistant Director of Fisheries for the year 2012-13 and to consequently promote the petitioner with retrospective effect from the date of promotion of his immediate junior with all consequential benefits.

Learned counsel appearing for the petitioner made a submission that the petitioner died on 09.01.2021 and efforts were taken to secure instructions from the legal heirs to get along with the case. In spite of the efforts, learned counsel is unable to get instructions and accordingly, reported no instructions.

In the aforestated circumstances, this Writ Petition is closed. However, if the legal heirs of the petitioner are willing to pursue the matter, they are at liberty to reopen the writ petition by filing an appropriate petition. No costs.
