Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Certiorarified Mandamus to call for the records of the 9th respondent in resolution dated 07.1.2013 file No.102/2012/F1 and quash the same and consequently direct the respondents to permit the members petitioner Society to use the lands in Ward F, Block No.3, comprised in T.S.No.6/1 admeasuring 2.33 acres as Kalam for their agricultural activities.

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) The learned Additional Government Pleader states that he has received instructions that the proposal sought to be assailed by the petitioner for construction of a hostel for the transgenders in the land admeasuring 2.33 acres as Kalam has been dropped and thus, their grievance does not survive. It is, however, clarified by the learned Additional Government Pleader that a separate proposal is in process for constructing hostel in the alternative land by transferring that land to the Social Welfare Department as per the norms. However, even qua that land transfer proposal, there is some internal opposition in the Government.
