Transfer civil miscellaneous petition filed under Section 24 of C.P.C., seeking to withdraw HMOP.No.574 of 2021from the file of the Sub-ordinate Court, Poonamallee and transfer the same to the file of the VI-Additional Family Court, Chennai with a direction to the VI-Additional Family Court, Chennai to try along with OP.No.2388 of 2021. The petitioner / wife seeks transfer of HMOP.No.574 of 2021 from the file of the Sub-ordinate Court, Poonamallee to the file of the VI-Additional Family Court, Chennai to be tried along with OP.No.2388 of 2021. OP.No.2388 of 2021 has been filed by the wife seeking divorce and HMOP.No.574 of 2021 has been filed by the husband before the Sub-Court, Poonamallee seeking divorce. The wife seeks transfer on the ground of convenience.

2.From the records, it is seen that the wife is a resident of Virugambakkam, which is more nearer to Sub-Court, Poonamallee than the Family Court at Chennai and the husband resides at Mogappair, which is also nearer to Poonamallee. I am of the considered opinion that it would be in the interest of the parties to have the proceedings before the Sub-Court, where https://hcservices.ecourts.gov.in/hcservices/

the parties are not required to appear for every hearing is an added advantage and the inconvenience caused to them will be greatly minimized. Hence, OP.No.2388 of 2021 is withdrawn from the file of the VI-Additional Family Court, Chennai and transferred to the Sub-Court, Poonamallee to be tried along with HMOP.No.574 of 2021.

3.This transfer civil miscellaneous petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
