ORDER

The Writ Petition is filed seeking a mandamus to direct the respondents not to prevent the petitioner or his representative from being present on 04.11.2020 at 14.30 hours or at any other time when the tenders are opened by the first respondent pursuant to the tender notice TN.No.7/HDO/NH/2020-2021, dated 11.09.2020 and subsequent amendment TN07/HDO/NH 2020-2021 dated 24.10.2020.

After notice, learned Special Government Pleader appearing on behalf of the respondents stated on the earlier occasion, i.e., on 03.11.2020 that the opening of the bid was postponed to 09.11.2020. It is also submitted that as everything is in "on-line", the technical bid will also be opened in on-line and it is open to the petitioner or any of the authorised representative to be present by logging into the link. The link and the password will be provided to the petitioner, upon making a request to the respondents. The petitioner is directed to clearly indicate as to whether, who will be participating in the opening of the tender, that is, whether the petitioner himself or any of his authorised representative. If so, the petitioner is also directed to give the particulars of the authorised representative, including the name, e-mail id/phone number, etc. to enable the respondents to permit the petitioner or his authorised representative to participate in the opening of the technical bid on-line. 3.

With the above directions, the Writ Petition is disposed of. No costs.
