The Learned Counsel appearing for the First and Second Respondents, on instructions, submits that the license granted to the Petitioner to operate the Cable TV Service Connection for the period from 01.11.2005 to 31.10.2006 has already lapsed and she cannot claim any right to carry on operations of granting cable TV connection.

In response to the aforesaid contention, the Learned Counsel for the Petitioner submits that the Respondents have not refunded the amount deposited as security deposit, till date.

The Learned Counsel for the First and Second Respondents states that if a representation is made by the Petitioner in that regard, the same would be considered and decision taken thereon.

In view of the aforesaid submissions made, the Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to the Petitioner to pursue the claim for refund of the security deposit made with the Respondents.

Accordingly, the Writ Petition is dismissed as withdrawn, granting liberty to the Petitioner to make such representation for refund of the security deposit made. If such representation is made, the Respondents shall expeditiously consider the same on merits, in accordance with law and communicate the decision taken to the Petitioner. However, it is made clear that this Court has not expressed any view on the correctness or entitlement of the claim sought to be made by the Petitioner for refund of the security deposit. No costs.
