ORDER

This Criminal Original Petition has been filed to direct the 7th respondent not to harass the petitioner in view of the complaint, dated 11.08.2021.

2.The learned counsel for the petitioner submitted that the petitioner was called for enquiry by the 7th respondent Police at odd hours and the 7th respondent Police failed to look into the fact that the petitioner is aged about 75 years and there is civil dispute with the 6th respondent.

3.The learned Government Advocate (Crl. Side) appearing for the respondents 7 and 8 submitted that the petitioner sold the property in document No.14330 of 2011 on 29.12.2021 to the 6th respondent.

When the 6th respondent about to put up construction, several persons had come there and made objection claiming right over the property. Later, it was found that the petitioner having no right over the property, sold the same to the 6th respondent and cheated him. He further submitted that when the petitioner was called for enquiry, he agreed to return back Rs.45 lakhs for the property sold without right or any authority. Now, he filed this petitioner terming that he has been unnecessarily harassed by the 7th respondent Police. 4.The learned counsel for the petitioner undertakes that he is ready to appear before the 7th respondent Police to settle the dispute with the 6th respondent and also to repay the amount as promised and agreed upon. On instructions, he submitted that the petitioner can appear before the respondent Police on 08.11.

2021. 5.In view of the above, the petitioner is directed to appear before the 7th respondent Police on 08.11.2021 and all future dates for further enquiry and also directed to cooperate with the enquiry and submit all documents in support of his explanation. 6.With the above direction, this Criminal Original Petition is disposed of.
