PRAYER:

This petition is filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the 1st respondent to consider the petitioner's representation dated 01.10.2015 for cancellation of patta issued in favour of 4th respondent and issue of patta in favour of the petitioner in respect of the land measuring to an extent of 1.12 acres in Survey No. 505 and land measuring to an extent of 1.68 acres in Survey No. 503 of Chinna Elasagiri Village, Hosur Taluk, Krishnagiri District pursuant to the proceedings in O.Mu.25535/2015/LR2 dated 05.10.2015.

ORDER

The petitioner made a representation on 01.10.2015 to the respondent No. 1, stating that the patta that stands as of now in the name of the respondent No. 4, will have to be cancelled by issuing the same in favour of the petitioner. On receipt of the same, the respondent No. 1, in and by proceedings in O.Mu.25535/2015/LR2 dated 05.10.2015, directed the respondent No. 3 to take appropriate action after due inquiry. Since, no further action is forthcoming on the part of the respondent No. 3, seeking to expedite the same, the present writ petition has been filed by the petitioner before this Court.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.

3. Considering the above facts and without going into the merits of the case, the respondent No. 3 is directed to consider and pass appropriate orders in pursuant to the proceedings in O.Mu.25535/2015/LR2, dated 05.10.2015, within a period of eight weeks from the date of receipt of copy of this order, after affording an opportunity of hearing to the petitioner and the respondent No. 4.

4. With the above direction, the present writ petition is disposed of. No costs.
