ORDER
[Order of the Court was made by N.MALA, J.,] This Writ Petition has been filed by the petitioner to grant 3 days leave without escort to her husband / detenu Raja @ Marur Raja, S/o.Selvaraj, aged about 40 years (Detention No.C2/09/2025), now detained at Central Prison, Cuddalore.
2. Heard the learned counsel on either side and perused the documents.
3.The petitioner herein seeks for grant of 3 days leave for her husband, without escort, on the ground that last rites of her father-inPage Nos.2/5
law namely father of the detenu, who died on 24.04.2025, has to be performed.
4.The learned Additional Public Prosecutor, on instructions, submits that the petitioner's husband may be granted leave with escort for one day.
5. Considering the submissions made on either side, we are inclined to grant leave in exercise of our powers under Article 226 of the Constitution of India.
6. Accordingly, the detenu Raja @ Marur Raja, S/o.Selvaraj, aged about 40 years (Detention No.C2/09/2025), now confined at Central Prison, Cuddalore, is hereby granted leave with escort commencing from 05.00 pm on 08.05.2025 till 05.00pm on 09.05.2025. On expiry of the leave, the detenu shall surrender before the prison authorities. During the period of leave, the detenu shall utilize the leave only for the purpose for which it has been granted and shall not indulge in any other activities.
