O R D E R
(This case has been heard through video conference) The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(4) of TN Schedule Commodities (RDCS)Order, 1982 r/w Section 7(1)(a)(II) of Essential Commodities Act, 1955 in Crime No.92 of 2019 , on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused have illegally transported 3550 kgs of PDS rice in a Lorry without any valid license or permission. Hence, the complaint.
3. The learned Counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor would submit that the petitioner along with other accused have transported https://hcservices.ecourts.gov.in/hcservices/
3550 kg of PDS rice in a Lorry. He would further submit there is one previous cases pending against the petitioner. Hence, he opposed for grant of Anticipatory bail to the petitioner.
5. Taking into consideration the submissions made by the learned additional public prosecutor and also the fact that the petitioner has transported huge quantity of 3550 kg of PDS rice illegally and the petitioner has one previous cases to his credit, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
