O R D E R
This petition is filed for the issuance of Writ of Mandamus directing the second respondent to consider the petitioner's representation dated 07.05.2018 for getting priority certificate in getting employment.
2. The case of the petitioner is that he is a farmer, cultivating in his own agricultural lands about 7.50 acres at Ponnivadi Village of Dharapuram Taluk. While so, the Government of Tamilnadu was intended to construct a check dam in his village and to implement the project, the Government started to acquire many lands of farmers assuring that the Government will provide good compensation and also Government job to one of their family members as per G.O.Ms.No.656 dated 29.06.1978. The grievance of the petitioner is that though his entire 7.50 acres of land were acquired by the respondents for the purpose of constructing the dam, till date no job opportunity were provided for the petitioner but his neighboring land owners who are similarly placed were given employment on the basis of priority certificate issued by the second respondent.
Aggrieved by the same, he made representation on 07.05.2018 to the respondents. On the basis of his representation, the third and fourth respondents herein considered his case and recommended the same to the second respondent. Till date, the said representation was pending before the second respondent. Since no action is forthcoming from the second respondent, the petitioner has filed the present Writ Petition.
3.The learned counsel for the petitioner would submit that without going into merits of the case since the representation made by the petitioner has been pending without any progress it would suffice if this Court directs the second respondent to consider and dispose of the representation made by the petitioner in accordance with law.
4.The learned Government Advocate appearing for the respondents while conceding the claim of the petitioner, would submit that if any such direction is given by this Court, the same would be complied with and the representation of the petitioner would be disposed of in accordance with law.
5. Considering the facts and circumstances of the case and the submissions made on either side, without going into the merits of the case, the second respondent is directed to consider and dispose of the representation dated 07.05.2018 made by the petitioner in accordance with law and on merits, within a period of 12 weeks from the date of receipt of a copy of this order.
6. With the above observation, this Writ Petition is disposed of. No costs.
