O R D E R

This Writ Petition has been filed to direct the respondents to relocate the transformer partially installed at the premises of the residential apartment owned by the petitioner, based on the representation dated 08.04.2025 submitted by the petitioner to the fifth respondent.

The learned counsel appearing for the petitioner submits that the petitioner is the absolute owner of the property situated at Door No.13, Balaji Singh Street, Saidapet, Chennai and she entered into a joint development agreement with a builder, pursuant to which, a residential apartment complex was constructed, in which, the petitioner was allotted six flats. While so, without prior notice or valid consent from the petitioner, the

respondents initiated installation of a high-voltage transformer inside the apartment premises and thereby, the petitioner made representations on 08.04.2025 and 03.05.2025 to shift the transformer in the convenient place, however, the same has not evoked any response so far. Therefore, the present writ petition has been filed.

The learned counsel appearing for the respondents submits that the builder who has entered into joint development agreement with the petitioner has made an application for installation of transformer and thereby, field inspection was conducted and transformer was erected. If the petitioner wanted to shift the transformer, she has to made an application with an undertaking affidavit that she will bear the cost and thereafter only, the officials will inspect the premises and find out the suitable place for erecting the transformer. If there is no possible for relocating the transformer, appropriate orders will be passed.

Considering the submissions made by both sides, this Court, without going into the merits of the case, grants liberty to the petitioner to file an appropriate application before the concerned respondent/Electricity Board. On filing such application by the petitioner, the concerned respondent shall consider the same for shifting the transformer in the convenient place and pass appropriate orders after providing opportunity to the petitioner as well as the developer within a period of four weeks from the date of receipt of a copy of this order.

5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Connected miscellaneous petitions are closed. 09.10.2025 NCC: Yes / No Index : Yes / No
