Criminal Original Petition has been filed under Section 482 of BNSS 2023, to enlarge the petitioner on bail in the event of his arrest pending investigation in Crime No.33 of 2023 on the file of the respondent police.

O R D E R

The petitioner/A2, who apprehends arrest at the hands of the respondent police, for the alleged offences punishable under Sections 408, 465, 468, 471 and 420 of IPC in Crime No.33 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is alleged to have misappropriated a sum of Rs.4,72,431/-, while he serving as a Cashier under the defacto complainant. The alleged offence is occurred during the year from 2017 to 2022. Whereas, the complaint is given only on 06.02.2023.

3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case.

4.The learned Government Advocate (Crl.Side) submitted that the co-accused has already been granted anticipatory bail. 2/6

5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner is directed to deposit a sum of Rs.1,00,000/- [Rupees One Lakh Only] to the credit of Crime No.33 of 2023 before the trial Court, on such deposit and production of proof, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on or before 04.09.2025, before the learned II Metropolitan Magistrte, Egmore, Chennai, on condition that the petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that:

(a)If the petitioner fails to surrender before the concerned Magistrate on or before 04.09.2025, this order shall stand automatically cancelled;

(b)The sureties shall affix their photographs and left thumb 3/6

impression in the application for surety ship (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity;

(c)The petitioner shall report before the respondent police as and when required for interrogation;

(d)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v. State of Kerala [(2005) AIR SCW 5560];

(e)If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
