Respondents Prayer: Petition filed under Article 226 of the Constitution of India praying for a writ of certiorarified mandamus, calling for the records relating to the impugned order passed by the second respondent in her proceedings in Na.Ka.1311/2020 PACCS, dated 20.04.2023 and quash the same and consequently directing the respondents to appoint the petitioner on the compassionate ground as Salesman or any other post in the third respondent society.

ORDER

The present writ petition is filed challenging the order dated 20.04.2023, whereby, the request of the petitioner to provide compassionate appointment was rejected.

Mr.C.Prakasam, learned counsel appearing for the petitioner would submit that the petitioner was not of eighteen years of age at the date of the death of the father of the petitioner, however, within a period of three years, after attaining majority, the petitioner has made an application and therefore, that may be considered in accordance with the Rules.

3. It can be seen that the petitioner was aged only 14 years when the petitioner's father died in the year 2007. Therefore, this question has already been referred to a Full Bench and is settled by this Court vide order dated 11.03.2020 in W.P.(MD)Nos.7016 of 2011 etc.

4. In view thereof, this Court is unable to come to the rescue of the petitioner. Therefore, finding no merits, the writ petition stands dismissed. There shall be no order as to costs. Consequently, W.M.P.No.17805 of 2024 is closed. 20.06.2024 drm
