The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1)(aaa), 4(1-A) of TNP Act, in Crime No.44 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused was found in illegal possession of 110 litres of Pondy arrack. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he is no way connected with the alleged offence. He further submitted that this is the second bail application before this Court. The earlier anticipatory bail application in Crl.O.P.No.7280 of 2022 was listed before the Hon'ble Mr.Justice Dr.G.Jayachandran on 05.04.2022 and the petitioner had sought for permission to withdraw the petition and he had

also made an endorsement to that effect. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner along with other accused was found in illegal possession of 110 litres of Pondy arrack. He further submits that there are 5 previous cases of similar in nature pending as against the petitioner and hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel on both sides and perused the entire materials available on record including the First Information Report.

6. Taking into account the nature of offence and the previous antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 28.06.2023 drl
