Petition seeking bail in respect of Crime No.156 of 2024 registered for the alleged offences punishable under Sections 177, 370(3) of IPC and Sections 80, 81 of the Juvenile Justice (Care and Protection of Children) Act, 2015, is on 1/6
board for consideration.
2. The case of the prosecution is that there are totally 11 accused in this case and the petitioner herein is arrayed as A-3. The allegation is that the accused A1 and A2 are having an extra marital affair and that through their relationship, a male child was born to them, for which the petitioner along with other accused persons, handed over a new born baby to A9 and A9 handed over the child to A10 and A11 and received a sum of Rs.7,00,000/-. Hence the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and a false complaint has been given against him. He also submitted that the petitioner is in no way connected with the alleged offence; that the co-accused was released on bail and he is suffering incarceration from 14.03.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. Learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing for grant of bail to the petitioner, reiterated the 2/6
prosecution case and submitted that the petitioner was arrested on 14.03.2025; that this petitioner is a relative to A1 and A2; that the petitioner has no bad antecedents.
5. Heard both sides and perused the materials available on record.
6. Taking note of the facts and circumstances of the case, nature of allegations, submissions made by the learned counsels on either side, the petitioner has no bad antecedents, co-accused was released on bail and the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner with certain conditions.
7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Coimbatore, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] the petitioner shall report before the respondent 3/6
Police, everyday at 10.30 a.m., for a period of one month and thereafter, as and when required for further interrogation; [c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
