, Advocate for the petitioner, the court made the following order:- On 01.07.2019, this Court granted interim stay on condition that the petitioner shall deposit 50% of the arrears amount before the Trial Court. On 29.07.2019, the learned counsel for the petitioner sought extension of time for complying with the order dated 01.07.2019. Accordingly, two weeks time was extended to comply with the said order.
2. Today, when the matter was taken up for hearing, the learned counsel for the petitioner submitted that the conditional order was not complied with. Hence, Crl.M.P.No.8516 of 2019 stands dismissed and the stay is vacated. It is open to the respondent/wife to execute the maintenance order under Section 128 Cr.P.C. and the pendency of the main Crl.R.C.No.613 of 2019 shall not be a bar for proceedings under Section 128 Cr.P.C.
