ORDER

(Order of the Court was delivered by HULUVADI G.RAMESH, J.) The petitioner seeks for issuance of a writ of mandamus, directing the first respondent to promote him and re-fix his seniority on the date of promotion of his juniors, namely, respondents 2 and 3 and re-fix his salary and draw arrears and pay the same to him.

2. Heard the learned counsel for the petitioner and the learned counsel representing the first respondent.

3. It appears that the petitioner was appointed as Peon/Office Assistant in the Madras High Court Service on 24.6.1981 and became Selection Grade Office Assistant on 26.6.91 on completion of 10 years of service. He was promoted as Record https://hcservices.ecourts.gov.in/hcservices/

Clerk on 1.3.2001 and further promoted as Record Assistant on 7.1.2011. Having exercised the option for promotion as Record Clerk and also for further promotion as Record Assistant at the relevant points of time, now he is complaining that his juniors, namely, the respondents 2 and 3, have been shown in the seniority list of Record Assistants above him. Since the grievance of the petitioner has been clarified by the records only on the option exercised by the petitioner, we are not inclined to accede to the prayer of the petitioner.
