Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to consider petitioner's representation dated 30.06.2008 for passing necessary orders to promote the petitioner to the post of Deputy Block Development Officer and extend the benefit to the petitioner as applicable and to pass any other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice.

The learned counsel for the writ petitioner made a submission that during the pendency of the writ petition, the petitioner was promoted to the Higher Cadre. However, his claim regarding the seniority has not been considered. In this regard, he made a representations to the 2nd respondent on 28.05.2008 and on 30.06.2008 and the same is yet to be considered.
2.Thus, without going into the merits of the matter, the 2nd respondent is directed to consider the representation submitted by the writ petitioner on 28.05.2008 and on 30.06.2008 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is directed to enclose the copies of the representation along with the orders passed in this writ petition.
