Respondents Prayer: Writ Petition filed under Section 226 of Constitution of India praying for issuance of Writ of Mandamus directing the 1st respondent to include the names of the petitioner and her son namely Venkadesh in the place of her deceased husband Mr.R.Rajarathinam in the joint patta bearing No.1170, Sozhatharam Village, Srimushnam Taluk, Cuddalore District and consequently direct the respondents to survey the lands and to make sub division and fix the boundaries to erect boundary stones in the property comprised of Survey Numbers 239/5B2, 239/7A2, 239/7B and 239/8 situated at Sozhatharam Village, Srimushnam Taluk, Cuddalore District and to issue separate patta to the petitioner and her sons in respect of their share. O R D E R

This Writ Petition has been filed for issue or Writ of Mandamus directing the respondents to act upon the application submitted by the petitioner, wherein, the petitioner is seeking for the inclusion of her name and the name of her son in the joint patta and she is also seeking for a direction to the respondents to survey the property and subdivide the same by fixing the boundary stones and thereafter issue separate patta in favour of the petitioner and her children. https://hcservices.ecourts.gov.in/hcservices/

2. Mr.S.N.Parthasarathy, Govt. Advocate, appearing on behalf of the respondents submitted that the 1st respondent has already called the petitioner for an enquiry on 09.12.2020 at 11 a.m. The learned counsel submitted that the petitioner can be present at the time of enquiry along with all the relevant documents.

3. Taking into consideration the facts and circumstances of the case and also of the fact that the 1st respondent has already called the petitioner for enquiry, there shall be a direction to the 1st respondent to conduct the enquiry and pass necessary orders strictly in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

4. This Writ Petition is disposed of with the above directions. No costs.
