Prayer: The Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure praying to direct the respondents to register FIR on the complaint dated 01.07.2021 filed by the petitioner pending on the file of the 3rd respondent and investigate the same and file report before the concern court within time framed by this Hon'ble Court. ORDER

(The case has been heard through video conference) This Criminal Original Petition has been filed seeking for a direction to the respondent police to register the FIR based on the complaint dated 01.07.2021 given by the petitioner. https://hcservices.ecourts.gov.in/hcservices/

2. The learned Counsel for the petitioner would submit that subsequent to the complaint dated 01.07.2021, the petitioner/defacto complainant withdrew the complaint on 16.07.2021 from the respondent police and thereby, nothing survives for adjudication.

3. The learned Government Advocate (Crl.Side) concurred with the statement of the learned Counsel for the petitioner and he also produced the copy of the letter dated 16.07.2021, given by the petitioner/defacto complainant to the respondent police.

4. Since, subsequent to the complaint dated 01.07.2021, the petitioner/defacto complainant has withdrawn the complaint on 16.07.2021, there is nothing survives for adjudication.

5. Therefore, this Criminal Original Petition is dismissed.
