[RESPONDENTS] PRAYER : Petition filed Under Article 226 of the Constitution of India praying to issue Writ of Mandamus, to direct the respondents to implement the order dt 11.9.2015 made in No.A/991/2014 passed by Inspector of Labour, Dharmapuri.

Heard Mr.K.Sasidran, learned Counsel appearing for the petitioners and Mr.Fakkir Mohideen, learned Standing counsel

appearing for the respondents and with their consent the Writ Petition is taken up for final disposal.

2.The petitioners seek for implementation of the order passed by the Inspector of Labour, Dharmapur, dated 11.09.2015. By the said order, the authority has directed to regularise the services of the petitioners. The learned Standing counsel appearing for the respondent Board submits that the respondent Board is taking steps to challenge the order passed by the Inspector of Labour dated 11.09.2015.

3.In any event, the petitioners should know as to whether the respondents are inclined to implement the order or are desirous of challenging the same and the said aspect of the matter has to be made known to the petitioners. However, it appears that the petitioners have not submitted any representation before seeking for issuance of a writ of mandamus. Therefore, this is a good ground to deny the relief sought for. However, liberty is granted to the petitioners to submit a representation to the third respondent and if the same is submitted, the third respondent shall pass orders on merits and in accordance with law, within a period of four weeks from the date of receipt of the representation from the petitioners.
