M/s.P.Veena Suresh Standing Counsel C O M M O N O R D E R These writ petitions have been filed seeking to quash the order of the second respondent dated 26.09.2018 and to direct the first respondent to grant licence to the petitioners to carry on business in accordance with Sections 20 and 21 of the Tamil Nadu Specified Commodities (Regulation of Location) Market Act, 1996.

2.The learned counsel appearing for the petitioners submitted that Koyambedu Wholesale Market Complex was established by the Government of Tamil Nadu as a Market Complex for Flowers, Fruits and Vegetables and CMDA decided to allot the godown in vegetable market to wholesale traders on outright purchase schemes. Accordingly, one P.M.Sebastian/ father of the petitioners was allotted Godown No.H-88 vide allotment order dated 08.04.2003 and after payment of the entire cost, the second respondent entered into a sale deed dated 31.08.2009 registered as Document No.2896 of 2009 in

the Office of the Sub-Registrar, Anna Nagar, Chennai and the said P.M.Sebastian became the absolute owner of Godown No.H-88 in Koyambedu Vegetable Market Complex admeasuring an extent of 4142.39 sq.ft. Thereafter he obtained combined licence for running the business in the Koyambedu Market and for his convenience, he made sub division and made application for issuance of licence and the same was rejected. 3.The learned counsel appearing for the petitioners further submitted that for the above said Godown, already the respondents issued combined licence in favour of the petitioners father and the same is going to expire. Hence, this Court may without going into the merits of the case, issue direction to the respondents to renew the combined licence granted in favour of the petitioners father.

4.The learned counsel appearing for the respondents submitted that the Godown is a single unit and sub-numbering of shops by the allottee is unauthorized, however, the combined licence granted in favour of the petitioners father will be periodically renewed. 5.Considering the limited request now made by the learned counsel appearing for the petitioners and the submission made by the learned counsel appearing for the respondents, this Court without expressing any opinion on the

merits of the case, directs the respondents to renew the combined licence granted in favour of the petitioners father.

6.The writ petitions are disposed of with the above direction. No costs.
