ORDER

This petition has been filed to direct the respondent police not to harass the petitioners under the guise of enquiry.

2. The petitioners, who are the husband and in laws of Sindhuja, has filed this petition seeking not to harass them by the respondent Police.

3. The contention of the petitioners is that the first petitioner and the said Sindhuja got married on 06.11.2020 and thereafter, due to some matrimonial dispute, they got separated. However, she lodged a false complaint against them projecting as dowry harassment. In the guise of enquiry, the petitioners are https://hcservices.ecourts.gov.in/hcservices/

called for enquiry and harassed by the respondent. Hence, the above petition is filed. They further submitted that they are ready for mediation.

The learned Government Advocate (Crl.Side) has submitted that Sindhuja, wife of the first petitioner lodged a complaint against the petitioners to the Superintendent of Police, which was forwarded in C.No.1465 of 2021 on 13.05.2021. The petitioners were called for enquiry and they appeared before the respondent and admitted that they received Sreedhana articles and valuable jewels and promised to hand over the same. The marriage has taken place recently on 06.11.2020. The defacto complainant has given a letter dated 13.07.2021 stating that the petitioner has assured to return the gold jewels and other valuable things and she agreed for divorce.

Considering the same, this Court finds that it is a case of matrimonial dispute and the respondent Police by following the Hon'ble Supreme Court directive for matrimonial case has conducted investigation. In view of the same, there is no harassment. The petitioners and the de-facto complainant shall appear before the Social Welfare Officer, Thiruvannamalai to resolve the matter amicably.

6. Accordingly, this Criminal Original Petition is dismissed.
