ORDER
This Writ Petition has been filed to forbear the fifth respondent from proceeding further on the basis of List of Electoral College dated 19.08.2021 in so far as it relates to members at S.No.23 of the said list allegedly representing the Petitioner Association. 2/5
2. The facts of the case are as follows:
The petitioner is a State Association promoting and developing Taekwondo Sport in Tamil Nadu. In the year 2018, sixth and seventh respondents were removed from the Association due to misappropriation of funds and also eighth respondent removed from the primary membership and the same was intimated to the fifth respondent/Tamil Nadu Olympic Association. The fifth respondent released the impugned electoral list including the name of seventh and eighth respondents for the purpose of conducting election for office bearers in Tamil Nadu Olympic Association on 19.08.2021. Immediately, the petitioner/Association sent notice to the fifth respondent to revise the names in Electoral College List in S.No.23 alone. Despite due notice, the fifth respondent has failed to revise the list. Hence, this petition is filed for the above said relief.
3.The learned counsel for the respondents submitted that the election period is going to be ended in the month of September, 2025 and the Suit in C.S.No.359 of 2021 is also pending before this Court. 3/5
In the light of the above submission, this Writ Petition is dismissed with liberty to the petitioner to canvas all the points before this Court where the Suit is pending. Consequently, connected Miscellaneous Petition is closed. No costs.
