Chandrakumar (for R5) (in W.P.Nos.17669 of 2018 & 21440 of 2019) Mr. B.Gopalakrishnan (for R5) (in W.P.Nos.17245, 29642, 29543, 29546, 29548 and 29550 of 2018 COMMON ORDER Since the issue raised in the writ petitions are almost identical vis-a-vis prayer sought for is also similar in nature, these writ petitions are taken up together and are being disposed of vide this common order.

All these writ petitions have been filed seeking to direct the Chief Educational Officer, Vellore to approve of appointments of the petitioners as B.T.Assistant and P.G. Assistant, etc., on the basis of the respective proposals submitted by the Correspondent, Concordia Higher Secondary School, Ambur, Vellore District and also to quash the impugned orders rejecting the approval of appointment of the petitioners as Teaching and Non Teaching Staff.

3. The Concordia Higher Secondary School, Ambur, Vellore District is a Minority Institution being administrated by the Indian Evangelical Lutheran Church, Ambur. It appears that when vacancies arose in respect of posts, viz., B.T. Assistant, P.G.Assistant and Head Master etc., though the Correspondent of the Concordia Higher Secondary School have sent proposals to the Chief Educational Officer, Vellore District for approval of the appointments through the District Educational Officer, no action has been taken by the authority in the matter of approval of the appointments sought for in the respective proposals and as the authority rejected the approval of appointment in the post of Head Master etc., these writ petitions have been filed. 4.When these writ petitions are taken up for hearing, the learned counsel appearing for the petitioners would submit that in respect of the Management of Indian Evangelical Lutheran Church (IELC) there were several disputes pending and by order dated 31.07.2018 in Tr.C.S.No. 741 of 2017 and A.No. 1695 of

2018 filed by the above Management, this Court has appointed Retired Judge of this Court as the Interim Administrator. The said order reads as follows:- "3. Accordingly, this Court appoints the Interim Administrator as Follows:

i.

that the Honourable Mr.Justice D.Hariparandaman (Retired Judge, High Court, Madras) residing at No.2, First Main Road, Kamaraj Nagar, Thiruvanmiyur, Chennai 600 041, Chennai 600 041, Phone No.044-24416340, be and is hereby appointed as Interim Administrator. ii. that the Interim Administrator appointed herein shall take charge and administer the India Evangelical Lutheran Church (IELC) till the entire dispute between the parties are resolved and new elections are conducted as per Byelaws of church.

Iii. that the Judge Commissioner appointed herein shall be paid a sum of Rs.1,00,000/- per month (Rupees One Lakh only per month) and the said sum shall be drawn from the funds of the church.

iv. That the Judge Commissioner shall also entitled for the car allowance on the basis of actually spent by him while discharging his duties as Administrator.

v. that the Interim Administrator appointed herein shall take the assistance of any lawyer of his choice for his administration purposes and for proper conducting of election and shall draw funds towards the expenditure for conducting election.

vi. That the Judge Commissioner appointed herein be and is hereby empowered to hire a personal secretary to assist him in his work and also entitled working space, personal staff and communication facilities and also draw assistance from the existing staff of the Church as he shall deem fit as necessary.

Vii. that the existing office bearers shall not take any major decision touching upon the financial matter, payments and other aspects

including any decision over immovable properties, appointments, etc., viii. that the existing office bearers and other officials of Church shall co-operate with the Interim Administrator for smooth administration of the Church.

4. while passing this order, the learned counsel appearing for the plaintiff in O.S.No.3261 of 2017 submitted that the plaintiff in O.S.No.3261 of 2017 has already been elected in the election which was held on 26.05.2017 and is continuing as office bearer and the said election has not been challenged.

5. the learned counsel also submitted that when the Administrator is appointed, their term would be cut short and the normal term as per Byelaws is three (3) years and hence submitted that those elected office bearers shall be allowed to continue to work along with the Administrator and to be monitored by the Administrator.

Till the dispute between the parties are resolved and new Committee being elected as per byelaws of the Church, the interim Administrator appointed by this Court will look after the affairs of the Church.

The learned counsel for the petitioners would further submit that appropriate orders may be issued to the concerned authority for approval of the appointments as sought for in the respective proposals.

Considering the facts and circumstances as well as the submissions made by the learned counsel for the petitioners and since the proposals sent by the Correspondent of Concordia Higher Secondary School seeking approval of the appointment of both teaching and non teaching staff are pending, without going into the merits of the case, this Court directs the Chief Educational Officer arrayed as respondent in all the writ petitions to consider the proposals submitted by the Correspondent of concerned School in the matter of approval of appointment of both teaching and non teaching staff and pass appropriate orders therein within a period of twelve weeks from the date of receipt of a copy of this order, on merits and in accordance with law. The concerned Chief Educational Officer is also directed to obtain views of the interim Administrator appointed by this Court in the matter of approval of the appointments.

8. With the above directions, the Writ petitions are disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed.
