ORDER
Earlier the matter was referred to mediation. However, the mediation proceedings failed. 2.The contention of the petitioner is that the petitioner had handed over all the articles of the
defacto-complainant. The defacto-complainant objects for the same stating that not all the articles have been handed over and there are some more articles left over. Further she submitted that she has materials to show that she was subjected to cruelty. 3.Today, when the matter is taken up for hearing, the learned Government Advocate (Criminal side) appearing for the respondent Police submitted that the petition enquiry in C.S.R.No.112 of 2025 is pending against the petitioners. 4.The learned Counsel for the petitioners submitted that the respondent police is harassing the petitioners under the guise of enquiry.
5. Considering the facts and circumstances, the respondent police is directed to conduct enquiry and if any prima facie case is made out against the petitioners, register the F.I.R or close the petition enquiry within a period of two weeks from today. The parties are directed to cooperate with the enquiry. It is needless to say that the respondent police shall not take any coercive steps to secure the accused till the completion of enquiry on the complaint lodged by the defacto complainant.
6. With the above directions, this criminal original petition is disposed of.
