115(3) of the Tamil Nadu Co-Operative Societies Rules, 1988 on the file of the 2nd respondent herein and quash the same and direct the respondent to withdraw all execution proceedings initiated under rules 115 and 116 of the Tamil Nadu Co-Operative Societies rules, 1988 as far as the property of the petitioner referred to in the impugned notice. ORDER
This Writ Petition has been filed for issuance of a Writ of Certiorarified Mandamus calling for the records relating to the impugned notice dated 18.06.2022 issued under Section 115(3) of the Tamil Nadu Co-Operative Societies Rules, 1988 on the file of the 2nd respondent herein and quash the same and direct the respondent to withdraw all execution proceedings initiated under rules 115 and 116 of the Tamil Nadu Co-Operative Societies Rules, 1988 as far as the property of the petitioner referred to in the impugned notice. 2/4
2. Today, when the matter came up for hearing, learned counsel appearing for the petitioner submitted that C.M.A.Nos.23 and 24 of 2019 have been dismissed by the Chief Small Causes Court by order dated 30.04.2024 and hence the Writ Petition may be dismissed as infructuous by recording the same.
3. In view of the endorsement and the submissions made by the learned counsel for the petitioner, this Writ Petition is dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petitions are closed.
