Respondents PRAYER: Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorarified Mandamus calling for the records of the order of the first respondent bearing proceedings in Na.Ka.No. 3/652/2022 dated 08.04.2022 and quash the same and consequently direct the respondents herein to correct the petitioner name as "MUTHUKUMAR" instead of "MOORTHY" in the birth certificate of the petitioner with registered No.6/1984, dated 18.03.1984 on the file of the second respondent. ***

ORDER

Th petitioner is called Muthukumar. That is the name given in his School certificates and in the college certificates and in his Aadhar Card and in all other official documents. However he found that in the birth certificate, his name had been wrongly given as "Moorthy" by his parents. He now wants to change his name to "Muthukumar", in which name in the other official records he is called.

Let the petitioner also take the step to change the name incorporating the changed name in the Government Gazatee and also by issuing public notice.

It is complained by the learned counsel for the respondent that under Section 15 of the Birth of the Tamil Nadu Registration and Deaths Act, 1969, only minor corrections can be incorporated. But let the petitioner after changing the name by way of publication in the Government Gazettee and by putting up a public

notice as required, give a fresh representation to the respondents to change the name in the birth certificate from "Moorthy" to "Muthukumar". Let necessary enquiries be conducted by the respondents and necessary corrections be made and then a fresh birth certificate can be issued.

It will also depend on the place of birth of the petitioner herein. The respondent may also call upon the petitioner to bring forward the hospital records where he was born and examine the names of the petitioner's parents and verify the details about the petitioner and thereafter issue a fresh birth certificate. The entire exercise should be completed after the petitioner officially changes the name in the Government Gazettee and by way of public notice within a period of six weeks thereafter.

With the above direction, the Writ Petition stands disposed of. No costs.
