After making submissions, learned counsel for the petitioner seeks permission to withdraw the original petition with liberty to file a fresh one and also prays for return of probate duty.

2.Though the learned counsel for the respondents raised some objections, this Court is of the view that those objections can be left open to be decided after numbering the fresh original petition. The probate duty paid is also ordered to be returned as it is a matter between the petitioner and the Court. Consequently, connected applications are closed.
