This is the Second bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 19.05.2022 for the offences punishable under Sections 448, 294(b), 323, 384, 376, 506(ii) of IPC r/w Section 4 of Tamilnadu Prohibition of Harassment of Woman Act altered into Sections 448, 294(b), 323, 376, 506(ii) of IPC r/w Section 4 of Tamilnadu Prohibition of Harassment of Woman Act in crime No.104 of 2022 on the file of the respondent police.
2. The case of the prosecution is that on 18.05.2022 at about 01.00 a.m., when the defacto complainant was sleeping in her house, at that time this petitioner trespassed into her house and closed her mouth by inserting a cloth. Thereafter, he beat her with stick and also threatened her that if she raised alarm, he would do away her. Further, he raped her and took away 3 sovereigns of gold chain and 1⁄2 sovereign of stud and 1⁄2 sovereign of Mattal. Thereafter, she was taken to hospital. Hence, the case.
3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.15079 of 2022, on 30.06.2022, considering the fact
that the petitioner had committed very serious offence as against the old woman.
4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
