This Civil Miscellaneous Petition has been filed to condone the delay of 917 days in filing the above appeal.

2. Heard the learned counsel for the petitioner and the learned counsel for the sole respondent.

3. The learned counsel for the sole respondent has no serious objection to allowing the petition.

4. The 1st petitioner would aver that, as he had moved to Kerala, there was a delay in receiving information from his counsel. Thereafter, upon returning to his native place, he took steps to prefer the appeal. Consequently, a delay of 917 days has occurred in filing the Civil Miscellaneous Appeal.

5. Though the reasons stated by the petitioner appear to be quite reasonable, she would further aver that, owing to financial constraints, the said delay of 917 days occurred in preferring the Civil Miscellaneous Appeal.

6. Accepting the averments made by the petitioner in the affidavit enclosed with the petition, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 917 days shall stand waived.
