2. The petitioner undertakes to pay 10% of the tax amount within a period of six weeks from the date of receipt of a copy of this order. Recording the said undertaking, the order impugned is set aside. The petitioner will appear before the respondent after hearing the petitioner and after perusing the materials, the respondent shall pass an order afresh on merits and in accordance with law.
