Respondents Petition filed under Article 226 of The Constitution of India praying to issue a writ of mandamus directing the 1st respondent to prohibit the respondents 2 and 3 from conducting election of office bearers for the 2nd respondent federation scheduled on 27.12.2015 without the petitioner in the voters list as per the representation of the petitioner dated 03.12.2015.

ORDER

The petitioner, who is the member of 2nd respondent has come forward to file this writ petition with a grievance that some of the members are not included in the membership list meant for voting.

2. The learned counsel for the petitioner submitted that despite the representation having been made on 03.12.2015, the mistake has not been rectified and therefore, until and unless the said anomoly is corrected, the proposed election shall not be allowed to go on.

3. The writ petition is not maintainable in such matters. The second and third respondents are not authorities under Article 12 of the Constitution of India. The first respondent does not have a role in the internal election. Further more, the election process has already began.

4. Therefore, this Court is not inclined to entertain this writ petition. Accordingly, this writ petition is dismissed. Consequently, connected miscellaneous petitions are closed. No costs.
