PRAYER Writ Petition filed under Article 226 of Constitution of India, to issue a writ of certiorarified mandamus to call for the entire records in SBA-2.No.453-1/IS/ TBM(c)/2024, dated 21.04.2025 on the file of 3 rd respondent and quash the same, consequently directing the respondents to provide Armed Personal Security Officer (PSO) to the petitioner in pursuant to the draft report dated 06.01.2025 served by the 5 th respondent along with police protection for round the clock to petitioners residence situated at No.D.203, Akshaya Metropolis Akshaya Avenue, GST Road, Maraimalai Nagar, Chengalpattu - 603 209. ORDER
The petitioner challenges the order passed by the third respondent dated 21.04.2025 and consequently direct the respondents to provide Armed Personal Security Officer (PSO) to the petitioner in pursuant to the draft report dated 06.01.2025 served by the fifth respondent along with police protection round the clock to the petitioner residence situated at No.D.203, Akshaya Metropolis Akshaya Avenue, GST Road, Maraimalai Nagar, Chengalpattu. 2/8
2.According to the petitioner, he is a Vice President of BJP (OBC Morcha) Tamil Nadu. Besides, social activist involved in public services and charity works. On instigation of high level political leaders, the local rowdy elements illegally demanded Rs.25 lakhs as ransom. Besides, they are blackmailing that unless it is paid, he will not be spared. Since there are continuous life threats, he filed a writ petition in W.P.No.15211 of 2022, the same has been disposed of by this Court vide order dated 20.06.2022 with a direction to the respondent police to consider the representation. 3.Despite the earlier order of this Court, directing the respondents to consider the request of the petitioner to provide P.S.O., the same was rejected. According to the petitioner, some post has been made in the social media by threatening his life and therefore, he challenges the order. 4.According to the petitioner, as if Samy @ Periyasamy, Naveen @ Naveenkumar and Bala @ Dhinakaran were demanding a ransom of Rs.25 lakhs and his life is at peril in their hands. 3/8
5.Learned Additional Public Prosecutor for the respondents submitted that the aforementioned names have not been found in any of the history sheeted A+ category rowdy. However, the respondents enquired the issue thoroughly and found that the petitioner is also a friend of them and established contact with the petitioner through his brother-in-law and running a quarry business in Andhra Pradesh. In the business transaction, the petitioner has to pay a sum of Rs.20 lakhs to them but fails to repay the said amount. That apart, the petitioner has also lodged a complaint on 19.04.2025 against the aforesaid persons. 6.It is submitted by the learned Additional Public Prosecutor that in order to escape from repaying money to them as well as in order to have PSO to gain political mileage, the petitioner has sent a false petition to the higher officers. It is further submitted that the accusation that he is having death perception from the above persons is false, fabricated and seems to be highlighted by the petitioner to gain weightage to his request for PSO. 4/8
7.It is the contention of the learned Additional Public Prosecutor that there was a business transaction between the petitioner and so called rowdy elements and the petitioner is due to pay a sum of Rs.20 lakhs to them in a business transaction. In support of his contention, photographs were filed to show that they are all friends.
8.When the Security Review Committee has found that there was no such threat as contended by the petitioner and the entire allegation made by the petitioner is false. The request of PSO was made in order to gain political mileage, the same was rejected by the Security Review Committee. Merely on the basis of some post published in social media, one cannot seek police protection as a matter of right. It is also to be noted that in respect of the petitioner several criminal cases are pending. 9.This Court in W.P.No.5163 of 2024 has clearly stated in paragraph No.26 of the order that wherever a person seeking for police protection has a criminal background and such a threat perception as a result of his own activities, this Court should be very hesitant to grant police protection. 5/8
10.It is to be noted that this Court has rejected the request of the petitioner in the earlier orders.
11.Considering the status report particularly the very specific allegation of the petitioner that so called rowdy elements alleged by the petitioner is also a friend of him and they were all together doing business and a threat has been made for some other reasons to gain some mileage in a political arena. This Court is of the view that orders rejecting the request does not suffer any infirmity.
12.With the above observations, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 28.08.2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes pam 6/8
