PRAYER: Second Appeal filed under Section 100 of C.P.C., against the judgment and decree dated 30.07.2013 in A.S.No.3 of 2013 on the file of II Additional Sub Court, Salem confirming the judgment and decree dated 03.08.2010 in O.S.No.467 of 2010, II Additional District Munsif Judge, Salem.

J U D G M E N T
The defendants in O.S.No.467 of 2010 who had suffered a decree for specific performance have come up by way of Appeal.
2. The parties have agreed upon a mode of settlement, in and by which the defendants/ agreement vendors have now agreed to convey an extent of 450 sq.ft out of 1050 sq.ft to the plaintiff/ respondent. They have also agreed to divide the remaining extent as shown in the plan annexed.
3. The parties and their respective counsels have signed the memorandum of compromise evidencing the above arrangement. The appellants as well as the respondent are present in court and they have affirmed that they have entered into a compromise. https://hcservices.ecourts.gov.in/hcservices/
4. In view of the same, there will be a decree in O.S.No.467 of 2010 in terms of compromise. The memorandum of compromise along with the two sketches attached to it will also form part of the decree. No costs. Consequently, the connected miscellaneous petition is closed.
