Respondents (R2 & R3 are impleaded as per order of this Court dated 16.08.2018 in MP.No.1 of 2010 in WP.No.13063 of 2010) Writ petition has been filed under Article 226 of the Constitution of India, praying for a Writ of mandamus directing the respondents to consider their representation with regard to Transfer of Patta dated 20.03.2010, on or before a date to be fixed by this Hon'ble Court.

ORDER

The prayer made in this writ petition is to direct the respondents to consider the representation dated 20.03.2010 submitted by the petitioner with regard to transfer of patta within a time frame to be fixed by this Court. 2.When the matter was taken up for consideration, the learned counsel appearing for the respondents 2 and 3, on instructions, submitted that with respect to the subject matter of the property, the plaintiffs, one of whom is the petitioner herein, filed a suit in O.S.No.331/2004 before the District Munsif Court, Tiruppur, which ended in decreetal; there against, the defendants in the said suit, who are the respondents 2 and 3 herein, preferred a first Appeal in AS.No.14/2008 on the file of the Principal Sub Court, Tiruppur and a second appeal in SA.No.186 of 2011 on the file of this Court, which were dismissed vide judgment and decree dated 29.09.2009 and 07.12.2016 respectively;

and the unsuccessful defendants/respondents 2 and 3 herein took the matter on appeal before the Supreme Court in SLP.No.15958/2017, wherein, vide order dated 16.08.2017, an interim order of status quo until further orders has been granted. The said submission has not been refuted by the learned counsel for the petitioner. 3.In the light of the aforesaid submission, this Court is of the opinion that no further order is necessary in this writ petition.
