When the matter is taken up for hearing, learned counsel appearing for the petitioner submits that the issue involved in the original petition no longer survives as the matter has been resolved between the parties. He would further submit that the original petition may be dismissed as infructuous and he has also made an endorsement to that effect.

2.In view of the endorsement made by the learned counsel for the petitioner, the original petition is dismissed as infructuous. No costs.
