Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarirfied Mandamus, call for the records pertaining to the impugned order passed by the 1st respondent in Proceedings No.2380/V2/2015 dated 23.01.2015 and quash the same as illegal and direct the first respondent to reinstate the petitioner into service.

By consent, the writ petition is taken up for final disposal.

2. Though the writ petition has been filed to quash the order of the first respondent dated 23.01.2015, the learned counsel appearing for the petitioner submitted that it would be suffice to issue a direction to the respondents to consider the representation of the petitioner dated 11.07.2015.

3. Mr.A.Ansar, learned counsel appearing for the petitioner submitted that recently the Hon'ble Supreme Court in the case of Ajay Kumar Chowdary Vs. Union of India reported in 2015 (3) SLR 414 (SC), has framed guidelines for extending the suspension order. Based on the above decision, the government has issued a letter No.13519/N/2015-1, dated 23.07.2015 to review the suspension of the employees.

4. The learned counsel further submitted that the petitioner was suspended on 19.01.2015, but subsequently, the respondent has not reviewed the suspension as per the judgment of the Hon'ble Supreme Court.

5. Heard the submissions of Mr.A.Ansar, learned counsel appearing for the petitioner, and Mr.V.Jayaprakash Narayanan, learned Special Government Pleader, who accepts notice on behalf of the respondents.

6. This Court, considering the submission of the learned counsel for the petitioner and without going into the merits of the case, directs the first respondent to consider and dispose of the representation of the petitioner dated 11.07.2015 and in the light of the judgment of the Hon'ble Supreme Court in Ajay Kumar Chowdary Vs. Union of India reported in 2015 (3) SLR 414 (SC) and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
