Prayer: Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus directing the 1st respondent to survey the land with regard to the land in Survey No.568/7, 11 at Venkattammapet Village, Chinnasalem Taluk, Kallakurichi district and demarcate the same and the 2nd respondent to provide adequate security for the purpose of survey and demarcation of the land when the 1st respondent inspects the land for measuring within the time frame fixed by this Court.

ORDER
This Writ Petition has been filed for the issue of a writ of mandamus directing the 1st respondent to consider the application filed by the petitioner, wherein the petitioner is seeking for the survey of the subject property and for demarcation of the same.
2.Mr.E.Balamurugane, learned Special Government Pleader appearing on behalf of the respondents would submit that the 1st https://hcservices.ecourts.gov.in/hcservices/
respondent has already fixed the date for preliminary enquiry on 10.12.2020 at 11.00 a.m. The learned counsel submitted that the 1st respondent will scrutinize the documents and take a decision to conduct the survey in the subject property. The learned counsel further submitted that the petitioner can be present at the time of enquiry along with all the relevant documents 3.Taking into consideration the facts and circumstances of the case and also of the fact that the 1st respondent has already called the petitioner for preliminary enquiry in order to take a decision with regard to conducting the survey in the subject property, there shall be a direction to the 1st respondent to complete the entire process within a period of six weeks from the date of receipt of copy of this order. It is made clear that if there are any other interested parties, the 1st respondent shall issue notice to them and thereafter take a decision in accordance with law.
4. This Writ Petition is disposed of with the above direction. No costs.
