This petition has been filed to condone the delay of 1410 days in filing the application to set aside abatement caused due to the death of fourth respondent in S.A.No.616 of 2005.

2. Notice to proposed respondent/5th respondent served. Despite name printed no one appeared on behalf of the 5th respondent and in respect of respondents 1 to 3 despite their name printed no one appeared.

3.Hence, considering the submission made by the learned counsel for the appellant and having satisfied with the averments made in the affidavit, this petition is allowed.
