This petition has been filed to set aside the abatement caused due to the death of the fourth respondent in the above appeal.

2. Notice to proposed respondent/5th respondent served. Despite name printed no one appeared on behalf of the 5th respondent and in respect of respondents 1 to 3 despite their name printed no one appeared.

3.Hence, considering the submission made by the learned counsel for the appellant and having satisfied with the averments made in the affidavit, this petition is allowed.
