(CRIME NO.RC MA1 2012 A 0037) Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition of the petitioner to appear before the learned XIV Additional Special (CBI) Court, Chennai first day of every month, as per the order on 05.08.2016 in Crl.MP.NO.8209/2016 in C.A.No.596/2016 in CC.NO.30/2013. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.T.S.N.PRABHAKARAN, Advocate for the petitioner, and of MR.K.SRINIVASAN Special Public Prosecutor For CBI Cases on behalf of the Respondent, the court made the following order:- The above petition is filed seeking to relax the condition imposed by this Court on the petitioner/appellant vide order dated 05.08.2016 made in Crl.MP.No.8209 of 2016 in Crl.A.No.596/2016 in C.C.No.30 of 2013.
This Court, in its order dated 05.08.2016,had suspended the sentence imposed on the petitioner with a direction to report before the Trial Court on the first working day of every English Calendar Month at 10.30 a.m., until further orders .
The learned counsel for the petitioner would submit that for the past three years the petitioner was regularly complying with the condition and due to his condition imposed he was unable to do his regular work and would seek that the condition of appearing before https://hcservices.ecourts.gov.in/hcservices/
the Trial Court on the first working day of every English calender month, be modified.
Heard the learned Special Public Prosecutor (CBI) and perused the affidavit filed in support of the miscellaneous petition. Taking into consideration due to his condition of the petitioner, the condition imposed vide order dated 05.08.2016, is hereby modified and the petitioner shall appear before the Trial Court once in three months on the first working day commencing from August-2019.
The petition is ordered accordingly.
