Even though an undertaking was given by the respondent to pay the balance amount of Rs.20,00,000/-, which is due and payable to the petitioner on or before 20.01.2025, the learned counsel for the respondent would now submit that the respondent is not in a position to pay the said amount on or before the stipulated date.

2. Today, the learned counsel for the respondent has produced two cheques viz., one Cheque bearing No.238650, dated 22.02.2025 for Rs.10,00,000/- and another Cheque bearing No.238651, dated 22.03.2025 for Rs.10,00,000/- respectively, issued by the respondent towards balance outstanding due and payable to the petitioner. A covering letter dated 23.01.2025 has also been given by the respondent undertaking to honour the said cheques on the due dates. The original cheques have been handed over to the learned counsel for the petitioner.
