The application filed by the petitioner before the trial Court invoking Order 7 Rule 11 C.P.C. was dismissed by the learned trial Judge, by order dated 12 January 2012 in I.A. No.1273 of 2011. The said order is under challenge in this civil revision petition.

3. The learned counsel for the respondents, on instructions, submitted that the trial Court decreed the suit as prayed for, by judgment and decree dated 28 June 2016 and as such, nothing survives for adjudication.

4. In view of the subsequent events relating to the disposal of the Civil Suit by the trial Court, the civil revision petition is dismissed as infructuous. No costs.
