This application has been filed seeking order of injunction restraining the 4th and 5th respondents from permanently or temporarily destroying or deleting the electronic records or other records of the plaint schedule E-mails in its possession till disposal of the main suit.
2. The suit itself is one for damages for defamation and for permanent injunction restraining the defendants from making any derogatory references to the plaintiff or its management in communications by e-mail or any other social media platform and for mandatory injunction directing the 4th and 5th defendants to give a status verification and authentication report of the plaint schedule emails.
3. According to the plaintiff, three e-mails stated in the plaint schedule contains a derogatory references against the plaintiffs. The defendants 4 and 5 / respondents 4 and 5 have filed affidavits stating that pursuant to Subpoena issued by the United States District Court for the Northern District of California in Civil Action No.5:14-CV-04103. kkn the said Court along with authentication. The copies of the said e-mails along with certificate of authentication have been filed before this Court by the defendants 1 to 3 in the typed set of the papers filed in the suit. It is also stated by the learned counsel for the respondents 4 and 5 that the contents of the emails cannot be destroyed both temporarily and permanently.
