ORDER
The petitioner, who was the then Director has come forward to file this writ petition challenging the Surcharge order No.2/2002 dated 26.3.2008 and the consequential attachment and sale notice dated 22.5.2015.

Though the learned counsel appearing for the petitioner submitted that some other person has already approached this Court and obtained interim order, this Court is not inclined to entertain this writ petition for two reasons. Firstly, the consequential order issued by the respondent is a Co-operative Society and therefore, no writ would lie. Secondly, as against the Surcharge order, the remedy is available before the Tribunal.
3. However, considering the submissions made and the Surcharge proceedings has been initiated against the number of other persons including the petitioner, who was directed at the relevant point of time, the writ petition stands disposed of by giving liberty to the petitioner to file an appeal against the Surcharge order dated 26.3.2008 within a period of four weeks from the date of receipt of a copy of this order. The period of limitation for filing the appeal is condoned on condition that the petitioner pays a sum of Rs.1 lakh to respondent Nos.2 and 3 within a period of four weeks from the date of receipt of a copy of this order. As and when, the petitioner files the appeal as indicated above, in the time granted, the appropriate authority will have to dispose of the appeal without rejecting it on the ground of limitation.
