The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 366(A) of IPC and Section 6 of POCSO Act, in Crime No.205 of 2022, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant is the mother of the minor victim girl. The husband of the victim girl and his family members harassed the victim girl. Further, they have aborted her pregnancy by giving abortion tablets. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor submits that there are totally three accused in which the petitioner is arrayed as A3. A1 fell in love with the victim girl and had sexual intercourse. Thereafter, the petitioner herein gave tablets to abort her pregnancy. He would further submit that there is no change of circumstances after the previous dismissal order passed by this
Court. Hence he vehemently opposed to grant anticipatory bail to the petitioner.
5. Taking into consideration the facts and circumstances of the case, the petitioner had committed very serious and heinous offence as against the minor victim girl. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 20.07.2022 mn
