(Order of the Court was made by R.SUBRAMANIAN, J.) Heard Mr. K.Sasindran, learned learned counsel appearing for the petitioners and Mr. K.Myilsamy, learned counsel appearing for the respondents 2 to 4/proposed parties.

2. Accepting the reasons assigned in the affidavit filed in support of these petitions, the delay in seeking to set aside the abatement of the appeal as against the first respondent is set aside, the abatement is also set aside and respondents 2 to 4 are brought on record as the legal representatives of the deceased first respondent and ranked them as respondents 3, 4 and 5 in the Appeal.

3. The Registry is directed to carry out the amendment and list the appeal for hearing on 17.12.2024.
