1.Mr.R.Neelamegham 2.Mrs.Sheela 3.Mr.Mathan ...Defendants This case came up for settlement before the Lok Adalat. M/s.R.Swarnavel, learned counsel appearing for the plaintiff is present. TERMS OF SETTLEMENT The Civil Suit in C.S.No.257 of 2016 pending on the file of High Court, Madras has been referred to Lok Adalat for conciliation today.
2. The present suit has been filed by the plaintiff against the defendants for a permanent injunction restraining the defendants and his men, agents, servants or anybody claiming under them or anybody acting on their behalf from in anyway https://hcservices.ecourts.gov.in/hcservices/ interfering with the peaceful possession and enjoyment of the suit property described in the plaint schedule and for costs.
3. The learned counsel appearing for the plaintiff represented that the dispute between the plaintiff and the defendants mentioned in the suit has been settled between both parties today before Lok Adalat and hence he is withdrawing the suit filed by the plaintiff.
4. The learned counsel made an endorsement as follows:- " As an agreement has reached between the parties today before the Hon'ble Lok Adalat. I being the counsel for the petitioner may be permitted to withdraw the suit and hence the suit may be dismissed as withdrawn".
5. In view of the above said endorsement made on the plaint, the Lok Adalat hereby declare and decree that the suit is dismissed as withdrawn. Award is passed accordingly. The full Court fee shall be refunded to the plaintiff in the manner provided under Section 69-A of the Tamil Nadu CourtFees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994 and there shall be no demand for additional Court fee.
