Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents herein to issue all the retirement benefits and also grant pension to the petitioner based on her representation dated 16.11.2015 within a stipulated time.

With the consent of both sides, the Writ Petition is taken up for final disposal.

2.The case of the petitioner is that he was appointed as sanitary worker in the third respondent/Mettur Municipality on 28.01.1998 on consolidated pay basis. Subsequently, his service was regularised and he retired from service on 30.06.2015 on attaining the age of superannuation. However, the respondents https://hcservices.ecourts.gov.in/hcservices/

have not settled the entire retirement benefits, therefore, the petitioner sent a representation dated 16.11.2015. Since, no order has been passed, the petitioner filed the present writ petition.

3.Heard the submissions of Mr.M.Senthil Kumar, learned counsel appearing for the petitioner and M/s.S.Gunasekaran, Government Advocate for R1 and R2 and Mr.S.Subbiah, learned counsel for R3 who accepts notice on behalf of the respondents. 4.This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits of the same, directs the third respondent to consider the representation of the petitioner dated 16.11.2015 and pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner. 5.The Writ Petition is disposed of accordingly.
